Employment Practices Liability Insurance

Protect your organisation, and your employees from claims

Employment Practices Liability Insurance can protect your organisation, as well as past and present directors, officers and employees, against disgruntled employees and job applicants.

Who needs this cover?

All Catholic organisations that employ staff are possible targets for claims by employees and job applicants. If your organisation employs people, or advertises and interviews to fill vacant positions, you need this insurance.

  • Wrongful refusal to employ an applicant for employment

  • Wrongful failure to promote an employee

  • Wrongful demotion, negligent evaluation, negligent reassignment or negligent disciplinary action

  • Wrongful termination of employment, including constructive dismissal

  • Unlawful workplace harassment or discrimination, which may include discrimination on the grounds of race, colour, sex, sexual preference, age, physical or mental status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin

  • Oral or written publication of material that defames an employee, or violates or invades an employee's right of privacy

  • Adverse action in contravention of Part 3-1 of the Fair Work Act 2009 (Cth)

  • Conduct in contravention of Section 31 of Schedule 2 of the Competition and Consumer Act 2010 (Cth)

  • Defence costs for bullying applications to the Fair Work Commission

  • Investigation costs up to $75,000 for investigations related to employment practices

What does employment practices liability insurance do?

Employment Practices Liability Insurance in action

After having her position terminated for wilful misconduct, a teacher files a formal complaint with the Fair Work Commission alleging unfair dismissal.

Because her former employer has Employment Practices Liability Insurance, CCI arranges legal representation for the teacher's employer in mediation at the Commission.

It is determined the teacher was unfairly dismissed and CCI appoints representatives to negotiate with the teacher on behalf of, and in consultation with, the school.

A settlement of three months' pay and legal costs of $40,000 are both covered by CCI.
